ANA to cancel more Dreamliner flights






TOKYO: Japan's All Nippon Airways (ANA) plans to cancel at least 379 flights in February due to the worldwide grounding of Boeing's Dreamliner, local media reported on Saturday.

The cancellations, which include 245 flights on domestic routes over 12 days from February 1 and 134 on international routes over 18 days, are expected to affect some 24,300 passengers, Jiji Press and Kyodo News said.

The total number of ANA cancellations since a January 16 emergency landing in western Japan will now amount to 838, with 82,620 travellers affected, Jiji said.

International flights expected to be hit next month will include those from Tokyo's Haneda and Narita airports to Frankfurt, San Jose, Seattle and Seoul.

Boeing's cutting-edge new planes suffered a series of glitches earlier this month, prompting a global alert from the US Federal Aviation Administration that led to the worldwide grounding of all 50 operational 787s.

CEA backs Dish in Hopper copyright lawsuit

The Consumer Electronics Association, a trade organization that represents 2,000 technology companies, voiced its support today for Dish Network's ad-skipping technology -- the focus of a heated multifront battle between the satellite TV provider and major broadcast television networks, including CBS, the parent company of CNET.


At issue is the legality of Dish's digital video recorder, the Hopper, including its "AutoHop" feature. AutoHop allows customers to record the entire prime-time lineup and automatically skip commercials. Broadcasters argue that the technology threatens to undermine an industry that depends on advertising revenue to help cover the cost of its shows.


The CEA filed an amicus brief yesterday before the 9th Circuit Court of Appeals -- along with the Computer and Communications Industry Association and the Internet Association -- arguing: "In sum and substance, the Hopper merely enables the consumer to perform the same actions as the old VCRs or other DVRs, just more efficiently." The brief relies heavily on the U.S. Supreme Court's ruling in Sony v. Universal City Studios, saying that recording TV programming for personal use is legal and the devices that make the recordings are not liable for copyright infringement.


CEA president Gary Shapiro said in a statement that "making television easier to watch is not against the law. It is simply pro-innovation and pro-consumer."


Fox, owned by News Corp., filed the lawsuit that's before the 9th Circuit. CBS Corp., parent company of CNET News, and other media companies are also in litigation against Dish. CBS filed an amended lawsuit earlier this week.


NBC Universal officials have previously argued: "Dish simply does not have the authority to tamper with the ads from broadcast replays on a wholesale basis for its own economic and commercial advantage." We reached out to NBC and CBS and we'll update the story when they comment. A Fox representative declined to comment on the CEA amicus brief.




The CEA runs the International Consumer Electronics Show, or
CES. The organization made the Hopper a 2013 Design and Engineering Award Honoree at the show earlier this month. In his statement, Shapiro maintains the Hopper will actually encourage people to watch more TV. He pointed to the tech industry's support of the product, citing CNET's initial decision to award the Hopper the "Best of CES" award. The Hopper was taken out of the competition for CNET's Best of CES owing to a conflict of interest related to CBS' ongoing litigation with Dish over its ad-skipping technology.


So far the court has not prevented Dish from selling the product. In August 2012, Fox filed for a preliminary injunction against the Hopper, but in November, a California district court denied its request to block sales of the device. Fox has appealed that ruling. The court did find that copies of programs Dish makes for its AutoHop function could constitute copyright infringement.


Separate pro-Hopper amicus briefs were filed yesterday by a group of law professors and nonprofit advocacy groups including the Electronic Frontier Foundation and Public Knowledge. Referring to the court's refusal to block sales of the Hopper, the advocacy groups said: "Copyright law does not grant copyright holders like Fox absolute control over the use of their works. The district court followed clear precedent and sound policy when it found that users of Dish's Ad Hopper do not trespass on Fox's exclusive rights, that Dish would not likely be liable for its customers' uses, and that Fox suffered no irreparable harm."



The CBS Television Network Affiliates Association and other broadcast affiliates filed their own amicus brief last month. It says: "This service -- particularly if it becomes ingrained and widespread -- threatens to devalue the advertisements on which local television stations rely to produce and acquire quality programming."

If you want the beauty of winter without having to brave the bone-chilling temperatures blasting much of the United States this week, snuggle into a soft blanket, grab a warm beverage, and curl up with some of these natural frozen wonders.

Nieve penitente, or penitent snow, are collections of spires that resemble robed monks—or penitents. They are flattened columns of snow wider at the base than at the tip and can range in height from 3 to 20 feet (1 to 6 meters). The picture above shows the phenomenon in central Chile. (See pictures of the patterns in snow and ice.)

Nieve penitente tend to form in shallow valleys where the snow is deep and the sun doesn't shine at too steep an angle, said Kenneth Libbrecht, a physicist at the California Institute of Technology in Pasadena who studies ice crystal formation.

As the snow melts, dirt gets mixed in with the runoff and collects in little pools here and there, he said. Since the dirt is darker in color than the surrounding snow, the dirty areas melt faster "and you end up digging these pits," explained Libbrecht.

"They tend to form at high altitude," he said. But other than that, no one really knows the exact conditions that are needed to form penitent snow.

"They're fairly strong," Libbrecht said. "People have found [the spires] difficult to hike through."

WH, Senators to Begin Push on Immigration Reform












The White House and a bipartisan group of senators next week plan to begin their efforts to push for comprehensive immigration reform.


President Barack Obama will make an announcement on immigration during a Tuesday trip to Las Vegas, Nevada, the White House said on Friday. The Senate group is expected make their plans public around the same time, the Associated Press reported.

For Obama, immigration reform is a campaign promise that has remained unfulfilled from his first White House run in 2008. During his 2012 re-election campaign, the president vowed to renew his effort to overhaul the nation's immigration system. It has long been expected that Obama would roll out his plans shortly after his inauguration.


The president's trip to Las Vegas is designed "to redouble the administration's efforts to work with Congress to fix the broken immigration system this year," the White House said.


Ever since November's election, in which Latino voters turned out in record numbers, Republicans and Democrats have expressed a desire to work on immigration reform. Obama has long supported a bill that would make many of the nation's 11 million undocumented immigrants without criminal records eligible to apply for an earned pathway to citizenship, which includes paying fines and learning English.

But the debate over a pathway to citizenship is expected to be contentious. Other flashpoints in an immigration reform push could include a guest-worker program, workplace enforcement efforts, border security, and immigration backlogs.


In a statement, the White House said that "any legislation must include a path to earned citizenship."


Ahead of his immigration push next week, Obama met today with a group of lawmakers from the Congressional Hispanic Caucus (CHC), including chairman Rubén Hinojosa (D-Texas) , Sen. Bob Menendez (D-N.J.), Democratic Caucus Chair Rep. Xavier Becerra (D-Calif.), and CHC Immigration Task Force Chair Rep. Luis Gutierrez (D-Ill.), the latter's office said. CHC members are expected to play a pivotal role in the debate.


"The president is the quarterback and he will direct the team, call the play, and be pivotal if we succeed. I am very optimistic based on conversations with Republicans in the House and Senate that we will do more than just talk about the immigration issue this year," Gutierrez said in a statement following the CHC meeting with Obama. "The president putting his full weight and attention behind getting a bill signed into law is tremendously helpful. We need the president and the American people all putting pressure on the Congress to act because nothing happens in the Capitol without people pushing from the outside."


A bipartisan group of eight senators, which includes Menendez, has also begun talks on drafting an immigration bill and will play an integral part in the process of passing a bill through Congress. Sen. Marco Rubio (R-Fla.), who has been participating in talks with others senators, has also unveiled his own outline for an immigration proposal.


The group of senators have reportedly eyed Friday as the date when they'll unveil their separate proposal, according to the Washington Post.

Shrinking proton puzzle persists in new measurement



































A puzzle at the heart of the atom refuses to go away. The most precise measurement yet of the proton's radius confirms that it sometimes seems smaller than the laws of physics demand – an issue that has been hotly debated for two years.












The latest finding deepens the need for exotic physics, or some other explanation, to account for the inconsistency. "If we were in a hole before, the hole is deeper now," says Gerald Miller of the University of Washington in Seattle, who was not involved in the new measurement.












The saga of the proton radius began in 2010, when a group led by Randolf Pohl at the Max Planck Institute of Quantum Optics in Garching, Germany, determined the width of the fuzzy ball of positive charge – and found it was smaller than had been assumed.












Previous teams had inferred the proton's radius, which is impossible to measure directly, by studying how electrons and protons interact. One method uses the simplest atom, hydrogen, which consists of one electron and one proton. A quirk of quantum mechanics says that an electron in an atom can only orbit its proton at certain distances, corresponding to different energy levels. The electron can jump between levels if it absorbs or releases energy in the form of a photon of light.











Ball of charge













By measuring the energy of photons emitted by an excited hydrogen atom, physicists can figure out how far apart the energy levels are, and thus the distances of the permitted electron orbits. A theory called quantum electrodynamics then allows them to calculate how far the proton's ball of charge must extend to keep the electrons at those distances.












This method gave a charge radius for the proton that was about 0.877 femtometres, less than a trillionth of a millimetre.












Pohl and colleagues used a novel method. They created an exotic version of hydrogen that replaces the electron with a muon, a particle that has the same charge as the electron but is 200 times heavier. Its extra bulk makes it more sensitive to the proton's size, meaning radius measurements based on muons are orders of magnitude more precise.












The new method didn't just make the measurements more precise. It also changed them: the muonic hydrogen gave a radius of 0.8418 femtometres, 4 per cent less than before.











Scandalous result












That might not sound like much, but in the world of particle physics, where theory and experiment can agree to parts in a billion, it was scandalous. A lively discussion sprang up, with some physicists claiming problems with Pohl's experiments and interpretations, and others suggesting gaps in the standard model of particle physics.













Pohl and colleagues have now repeated their experiment. The measurement of the radius is now even more precise than in 2010 – and it is still 4 per cent smaller than the value from hydrogen-based experiments.












Pohl reckons that there are three likely explanations. His experiment could have errors, although the confirmation makes that less likely. Alternatively, the electron experiments could be off. "This would be the most boring possibility," says Pohl.












The third, and most exciting, possibility is that muons do not interact with protons in the same way as electrons. In other words, the proton's apparent radius changes a little bit depending on which particle it is interacting with.












If true, that might require the existence of unknown particles that alter the way the muon interacts with the proton. Those particles could, in turn, solve some of the problems with the standard model of particle physics. They could, for instance, provide a candidate for dark matter, the mysterious stuff that makes up more than 80 per cent of the mass in the universe.











Monumental idea













Miller, Pohl and Ron Gilman of Rutgers University in Piscataway, New Jersey helped organise a workshop with 50 proton experts in Trento, Italy, last October to hash out the details of the problem – and arrived at a verdict of sorts. "Because the muon experiments seem to be so solid, the most popular answers were that there's some beyond-the-standard-model physics differentiating between muon and electron, which would be very important," Gilman says.












"That would be monumental, truly," Miller says.












But Miller also has a less radical suggestion, which could reconcile all the measurements without invoking new particles. According to quantum electrodynamics, two charged particles can interact with each other by exchanging a photon – it's as if they spontaneously create a basketball and throw it between them, he says.












The equations also allow for a more complicated interaction where the particles create two balls, and juggle them. Until now this type of interaction was considered too rare to be important, but Miller reckons that the muon's greater mass could make it a better juggler. That would strengthen the proton's interaction with it and make the proton look smaller to the muon without requiring any new physics.












All these ideas will be up for review in a few years' time when new experiments, including shooting muons at protons to see how they scatter and building muonic helium atoms to measure their energy levels, are completed.












"It's quite likely that through other experiments, in two to three years we might get an end to this," Miller says. "It shouldn't take forever."

Kia Motors posts 6.7% fall in Q4 net profit






SEOUL: South Korea's Kia Motors on Friday reported a 6.7 percent fall in its fourth-quarter net profit, blaming a stronger won and compensation payouts to US customers for inflated gas-mileage claims.

Consolidated net profit for the three months ended December 31 fell to 737.5 billion won ($689 million) from 790.4 billion won a year earlier, the country's second largest automaker said in a statement.

A stronger won took its toll on the bottom line, and the company had to pay a one-off compensation claim worth 200 billion won to US customers following lawsuits over inflated mileage claims.

The US Environmental Protection Agency found that both Kia and Hyundai Motor -- which owns a 34 percent stake in Kia -- had exaggerated the fuel efficiency numbers on 2012 and 2013 models of cars sold in the US market.

Labour strikes at Kia in the third quarter depressed inventories in the October-December period, the company said.

Operating profit slumped 51 percent to 404.2 billion won from 826.9 billion won a year earlier, while sales rose 2.8 percent to 11.3 trillion won from 11.0 trillion won.

Samsung, Apple dominate as 700M smartphones ship in 2012




A record 700 million smartphones shipped last year, with Samsung and Apple accounting for half the market, according to new research released today.


While global smartphone shipments increased 490.5 million units over 2011, the 43 percent growth rate slowed in comparison to 2011's growth rate of 64 percent over 2010, according to market researcher Strategy Analytics. The research blamed saturation in North America and Western Europe for the slower growth.


"Large marketing budgets, extensive distribution channels, and attractive product portfolios have enabled Samsung and Apple to tighten their grip on the smartphone industry," the market researcher said in a blog post today.


Samsung captured 30 percent of the market with 213 million smartphones shipped worldwide, blowing away the previous record of 100 million smartphones shipped by Nokia in 2010. The study said the company had success with a wide range of models, from the pricier
Galaxy Note 2 phablet to the less-expensive Galaxy Y.




Apple captured 19 percent of the market with 135.8 million units shipped last dyear, a 46 percent increase over 2011. The iPhone maker benefited from strong demand in North America but was hobbled by limited presence in developing markets such as Africa, the researchers said.


Nokia retained its position as the No. 3 smartphone maker in 2012, but its market share dropped from 16 percent to 5 percent.


"Nokia's Windows Phone portfolio has improved significantly in recent months, with new models like the
Lumia 920, but we believe the vendor still lacks a true hero model in its range that can be considered an Apple iPhone or Samsung S3 killer," Strategy Analytics said.

Meanwhile, the global mobile phone market, which includes feature phones, was largely flat, growing only 2 percent with 1.6 billion units shipped in 2012. The study blamed the market's modest growth on a variety of causes, including tighter upgrade policies, changing consumer tastes, and economic challenges in North American and Western Europe.

Deformed Dolphin Accepted Into New Family


In 2011, behavioral ecologists Alexander Wilson and Jens Krause of the Leibniz-Institute of Freshwater Ecology and Inland Fisheries in Germany were surprised to discover that a group of sperm whales (Physeter macrocephalus)—animals not usually known for forging bonds with other species—had taken in an adult bottlenose dolphin (Tursiops truncatus).

The researchers observed the group in the ocean surrounding the Azores (map)—about 1,000 miles (1,600 kilometers) off the coast of Lisbon, Portugal—for eight days as the dolphin traveled, foraged, and played with both the adult whales and their calves. When the dolphin rubbed its body against the whales, they would sometimes return the gesture.

Among terrestrial animals, cross-species interactions are not uncommon. These mostly temporary alliances are forged for foraging benefits and protection against predators, said Wilson.

They could also be satisfying a desire for the company of other animals, added marine biologist John Francis, vice president for research, conservation, and exploration at the National Geographic Society (the Society owns National Geographic News).

Photographs of dogs nursing tiger cubs, stories of a signing gorilla adopting a pet cat, and videos of a leopard caring for a baby baboon have long circulated the Web and caught national attention.

A Rare Alliance

And although dolphins are known for being sociable animals, Wilson called the alliance between sperm whale and bottlenose dolphin rare, as it has never, to his knowledge, been witnessed before.

This association may have started with something called bow riding, a common behavior among dolphins during which they ride the pressure waves generated by the bow of a ship or, in this case, whales, suggested Francis.

"Hanging around slower creatures to catch a ride might have been the first advantage [of such behavior]," he said, adding that this may have also started out as simply a playful encounter.

Wilson suggested that the dolphin's peculiar spinal shape made it more likely to initiate an interaction with the large and slow-moving whales. "Perhaps it could not keep up with or was picked on by other members of its dolphin group," he said in an email.

Default

But the "million-dollar question," as Wilson puts it, is why the whales accepted the lone dolphin. Among several theories presented in an upcoming paper in Aquatic Mammals describing the scientists' observations, they propose that the dolphin may have been regarded as nonthreatening and that it was accepted by default because of the way adult sperm whales "babysit" their calves.

Sperm whales alternate their dives between group members, always leaving one adult near the surface to watch the juveniles. "What is likely is that the presence of the calves—which cannot dive very deep or for very long—allowed the dolphin to maintain contact with the group," Wilson said.

Wilson doesn't believe the dolphin approached the sperm whales for help in protecting itself from predators, since there aren't many dolphin predators in the waters surrounding the Azores.

But Francis was not so quick to discount the idea. "I don't buy that there is no predator in the lifelong experience of the whales and dolphins frequenting the Azores," he said.

He suggested that it could be just as possible that the sperm whales accepted the dolphin for added protection against their own predators, like the killer whale (Orcinus orca), while traveling. "They see killer whales off the Azores, and while they may not be around regularly, it does not take a lot of encounters to make [other] whales defensive," he said.

It's Official: Women Will Serve in Combat













Women will soon be able to serve in combat, as things officially changed with the stroke of a pen today at the Pentagon.


At a joint news conference, Secretary of Defense Leon Panetta and Joint Chiefs of Staff Charman Gen. Martin Dempsey signed a memorandum rolling back a 1994 directive prohibiting women from doing so.


"They serve, they're wounded, and they die right next to each other," Panetta said of women and men in the military. "The time has come to recognize that reality.


"If they're willing to put their lives on the line, then we need to recognize that they deserve a chance," Panetta said, noting that he wants his own granddaughters and grandsons to have the same opportunities in their lives and careers.


The change won't be immediate, however. While Panetta announced that thousands of new positions will now be open to women, he has asked the military branches to submit plans by May on how to integrate women into combat operations. He set a January 2016 deadline for branches to implement the changes, giving military services time to seek waivers for certain jobs.


Both Panetta and Dempsey said they believe the move will strengthen the U.S. military force.

"Ultimately, we are acting to strengthen the armed forces," Dempsey said. "We will extend opportunities to women in a way that maintains readiness, morale and unit cohesion."


Women have already served in combat in Iraq and Afghanistan, as ABC News' Martha Raddatz and Elizabeth Gorman reported in 2009: Prohibited from serving in roles "whose primary mission is to engage in direct combat on the ground," women in support roles, nonetheless, served in support roles on the frontlines, where they have fought, been wounded and died.


Women have also flown combat missions since 1993 and have served on submarines since 2010.


Panetta noted that 152 women have died serving in the U.S. military in Iraq and Afghanistan. Dempsey said he realized a change was inevitable when he noticed two female turret gunners protecting a senior military officer.


"It's clear to all of us that women are contributing in unprecedented ways to the military's mission of defending the nation," Panetta said. "Women represent 15 percent of the force of over 200,000 [and] are serving in a growing number of critical roles on and off the battlefield.


"I've gone to Bethesda to visit wounded warriors, and I've gone to Arlington to bury our dead. There's no distincton."


Panetta and Dempsey said President Obama supported the move, while warning them to maintain military readiness as they considered the change.


Obama hailed the move in a written statement


"Today, by moving to open more military positions -- including ground combat units -- to women, our armed forces have taken another historic step toward harnessing the talents and skills of all our citizens," he said.


"This milestone reflects the courageous and patriotic service of women through more than two centuries of American history and the indispensable role of women in today's military," Obama said.
